These terms govern your use of the Guardian Monitor application. By installing or using the application you accept them. If you do not accept them, please do not use the application.
Guardian Monitor is developed and operated by Kacper Rychliński, Poland ("we", "us"). You can reach us at kacper.rychlinski@gmail.com.
This is the most important part of these terms, so please read it carefully.
Guardian Monitor is an informational application. It is not a medical device, it has not been certified as one, and it must not be used as a basis for medical decisions. Do not use it to decide on an insulin dose, to treat a low or high blood glucose level, or in place of a blood glucose meter.
The application only displays data that your CGM service already holds. It cannot verify whether that data is correct, current or complete. Readings may be delayed, missing or wrong for reasons entirely outside our control — a sensor error, a lost Bluetooth connection, a phone that stopped uploading, an outage at your provider, or no internet connection on your own device.
The alarms are a convenience, not a safety system. They depend on your device being switched on, on notifications and sound being permitted, on a working internet connection, and on your provider delivering data. They can fail silently. Never rely on them as the only means of detecting a dangerous glucose level.
For treatment decisions always use your CGM manufacturer's own certified application and follow the guidance of your healthcare team.
To use Guardian Monitor you need an iPhone with a supported version of iOS, an internet connection, and an active account with one of the supported CGM services — currently Medtronic CareLink or Sibionics.
You are responsible for your account with that service and for keeping your credentials safe. If you use the application to follow another person's glucose data, it is your responsibility to have that person's consent, or the right to act on their behalf.
Guardian Monitor is an independent application. It is not affiliated with, endorsed by, or connected to Medtronic or Sibionics, and we do not act on their behalf. Their names are used only to describe compatibility.
The application only reads data. It never changes settings, thresholds, insulin delivery or anything else in the service you connect to.
Some features require an active subscription: Live Activities with full 8-hour access, alarms, the Apple Watch application, Nightscout synchronisation, Apple Health synchronisation and spoken readouts. The remaining features are free to use.
Subscriptions are sold through Apple's In-App Purchase system, and the price for your region is shown in the application before purchase. Payment is taken by Apple, and a subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You manage and cancel subscriptions in the settings of your Apple Account, not in this application.
Subscriptions are family shareable: a single purchase covers the members of the purchaser's Family Sharing group. Where a free trial is offered, it is granted by Apple once per family group.
Refunds are handled by Apple under their own terms. We cannot issue refunds for purchases made through the App Store.
If a subscription expires, the application keeps working without the subscription-only features. Nothing is deleted.
You may use Guardian Monitor for your own personal, non-commercial purposes. You may not copy, sell, rent, sublicense or redistribute the application, attempt to reverse engineer or decompile it except where the law expressly allows this, or use it in a way that breaks the terms of your CGM provider or any applicable law.
The application, its source code, design, name and graphics belong to us and are protected by copyright. These terms grant you a personal, non-transferable licence to use the application, and nothing more.
We do our best to keep the application working, but we cannot guarantee uninterrupted availability. Guardian Monitor depends on services we do not control. A CGM provider may change or withdraw its interface at any time, which can break part or all of the application without warning, and Apple may change platform behaviour in ways that affect it.
We may add, change or remove features, and we may stop supporting a given provider or an older system version. Where such a change materially affects paid features, we will announce it in the application beforehand.
To the extent permitted by law, we are not liable for any damage arising from the use of or inability to use the application, including missed, delayed or incorrect glucose readings, alarms that did not sound, or decisions made on the basis of the displayed data.
Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded under applicable law. If you are a consumer, your statutory rights are not affected.
You may stop using the application at any time by deleting it. We may suspend access if the application is used in breach of these terms or of the law.
We may update these terms as the application changes. The new version is published on this page with an updated date at the top. Continuing to use the application after a change means you accept the new version.
These terms are governed by Polish law. If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence.
